A Delhi court denied a request for extended police custody and sent AAP MLA Naresh Balyan to judicial custody in a case involving alleged organized crime under MCOCA. This decision follows Balyan’s arrest on December 4, which has ignited political debate. His legal team is anticipated to challenge the allegations amid ongoing scrutiny.

New Delhi: In a high-profile development, a Delhi court on Friday sent AAP’s Uttam Nagar MLA Naresh Balyan to judicial custody in a case involving alleged organized crime. The decision came as the court denied the Delhi Police’s request for a further 10-day remand.

Special Judge Kaveri Baweja passed the order after Naresh Balyan was produced before the court following the expiry of his seven-day police custody, which had been granted earlier in connection with the case lodged under the stringent Maharashtra Control of Organised Crime Act (MCOCA).

The Delhi Police, represented by Special Public Prosecutor Akhand Pratap Singh, argued for an extension of Balyan’s custody, citing the need to “unearth the larger conspiracy” behind the organized crime allegations. However, the judge dismissed the application, opting to send the MLA to judicial custody instead.

Naresh Balyan’s arrest on December 4 has stirred political and public discourse. He was taken into custody in relation to an alleged organized crime case, even as a separate court had granted him bail in an unrelated purported extortion case.

The dismissal of the police’s request for further remand has been seen as a significant judicial decision in the case, which continues to unfold amid heightened scrutiny. The allegations under MCOCA indicate the severity of the charges, while Balyan’s legal team is likely to challenge the claims in the coming proceedings.

The MLA’s judicial custody marks the latest development in the ongoing investigation, with the court prioritizing judicial oversight over further interrogation by the police. The case has added to the controversies surrounding the Aam Aadmi Party (AAP), with political rivals seizing the opportunity to criticize the party.

As the case progresses, it is expected to draw further public and media attention, especially given the serious nature of the allegations and the high-profile stature of the accused. The decision to deny an extended police remand underscores the judiciary’s role in balancing investigative needs with the rights of the accused.
