CJI DY Chandrachud Emphasizes the Importance of Balancing Seizure Powers with Individual Privacy Rights in Probe Agencies

Today(1st April), Chief Justice DY Chandrachud emphasized the need to balance investigation agency powers with individual privacy rights for fairness and justice.

Chief Justice DY Chandrachud of India stressed the importance of striking a delicate balance between the authority of investigation agencies such as the Central Bureau of Investigation (CBI) to conduct searches and seizures, and the fundamental right to privacy of individuals. He highlighted this balance as essential for ensuring fairness and justice in society during his keynote speech at the 20th D P Kohli memorial lecture in the Capital.

The Chief Justice emphasized that maintaining due process is crucial at the core of this balance.Additionally, , he raised concerns about the unjust seizure of personal devices, stressing the urgency of finding a middle ground between investigative needs and individual privacy rights.

The CJI urged probe agencies to “choose their battles wisely” instead of dispersing their efforts across numerous cases.

The CJI stated,

“They should concentrate on crimes that threaten security and economic health of the country and public order.”

He also added,

“The landscape of crime is evolving at an ‘unprecedented pace,’ and it’s imperative for probe agencies such as the Central Bureau of Investigation (CBI) to enhance their capabilities to address these challenges, including leveraging Artificial Intelligence (AI) tools”

The Chief Justice of India noted that with the rise of digital technologies, the world has become more interconnected. This includes challenges such as cybercrime, digital fraud, and emerging technologies.

He highlighted that law enforcement agencies like the CBI are encountering new and intricate challenges that require innovative solutions.
