KOLKATA: Today(on 7th March), the Calcutta High Court has raised serious questions regarding the continuation of Trinamool Congress (TMC) leader Shahajahan Sheikh as the Pradhan of the Zilla Parishad in Sandeshkhali, following his arrest linked to grave allegations including sexual assault of women in the region.

During a session presided over by Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharyya, the court explicitly instructed Sheikh’s legal representative, Sabyasachi Banerjee, to ensure that Sheikh refrains from exercising any powers associated with his position as Pradhan until further notice. This directive underscores the judiciary’s intent to maintain the integrity of public office while legal proceedings are underway.

The bench posed a poignant question regarding Sheikh’s suitability for his role amid the allegations:

“Should Shahjahan Sheikh continue on the position of the chief of Zilla Parishad?”

This query was directed towards Advocate General (AG) Kishore Datta, who disclosed Sheikh’s suspension from the TMC, reflecting the party’s stance on the matter.

However, the situation’s complexity was highlighted by Additional Solicitor General (ASG) Ashok Kr Chakraborty, who pointed out that Sheikh still retains rights akin to those of a State Cabinet Minister, prompting discussions on the necessity of his immediate suspension or removal from the Pradhan position. AG Datta noted that any removal would need to adhere to a democratic process as outlined by law, indicating the procedural nuances involved in addressing such high-profile cases.

The court’s stance was clear, as reflected in the Chief Justice’s directive:

“Mr. Banerjee, you will have to ensure that your client (Sheikh) doesn’t exercise any of his powers, at least till next date.”

This statement not only emphasizes the court’s immediate concerns but also hints at the ongoing legal scrutiny that Sheikh will face in the coming days.

This Suo motu case initiated by the court, focusing on allegations of land grabbing and the sexual assault of women in Sandeshkhali, purportedly involving Sheikh and his associates. The narrative deepens with reports that the District Magistrate and the Block Development Officer (BDO) are actively returning lands allegedly seized by Sheikh back to their rightful owners, though questions remain about the restoration of these lands to their original condition.

In response to these unfolding events, the court has mandated the State to clarify the status of the reclaimed lands and has called upon the Central Bureau of Investigation (CBI) to outline its capacity to protect witnesses in this high-stakes case. This move comes amid concerns over potential witness tampering, as highlighted by one of the advocates during the hearing.

Moreover, the court has urged the State to engage in “confidence building” within the troubled area to prevent further disturbances, showcasing a holistic approach to restoring peace and order.

Sheikh’s involvement goes beyond the present accusations, encompassing a ration distribution scandal that resulted in his recent apprehension by the State police. In a noteworthy development, prompted by a High Court directive, Sheikh has been handed over to the CBI custody, signifying a substantial change in the course of the investigation.

Sheikh’s legal troubles are compounded by his alleged involvement in an attack on Enforcement Directorate (ED) officers during a raid at his residence in Akunjipara, linked to the ration scam. The incident, which resulted in injuries to ED personnel, paints a picture of a deeply entrenched conflict involving law enforcement and political figures.

The Calcutta High Court schedules the next hearing for 4th April.
