[Unnao Rape Case] Delhi High Court Grants Interim Bail to Kuldeep Singh Sengar for Cataract Surgery

The court directed that Sengar be released on Thursday, January 23, 2025, to allow him to be admitted to the All India Institute of Medical Sciences (AIIMS) on Friday, January 24. The bench made it clear that if the surgery was not conducted on January 24, Sengar would have to surrender to jail on the same day.

NEW DELHI: On Wednesday(22nd Jan), the Delhi High Court granted interim bail to Kuldeep Singh Sengar, a former Bharatiya Janata Party (BJP) MLA and convicted in the Unnao rape case, so that he could undergo cataract surgery.

The court directed that Sengar be released on Thursday, January 23, 2025, to allow him to be admitted to the All India Institute of Medical Sciences (AIIMS) on Friday, January 24. The bench made it clear that if the surgery was not conducted on January 24, Sengar would have to surrender to jail on the same day.

The court further ordered that a Delhi Police constable be posted outside Sengar’s ward at AIIMS to ensure his security during the procedure. The Court also specified that he must surrender back to jail by January 27, 2025. “Needless to say, no further extension shall be granted,” the Court clarified.

This is the second time that Sengar has been granted medical bail. Earlier, the Court had granted him interim bail on medical grounds until December 20, 2024, for a medical assessment at AIIMS. Later, the medical bail was extended for another four weeks until January 20, 2025, with the observation that no further extensions would be granted. After the expiry of the medical bail, Sengar surrendered to the Tihar Jail authorities on January 20, 2025.

Following his surrender, Sengar moved the Court once again, requesting suspension of his sentence for 30 days so that he could undergo cataract surgery. Senior Advocate Manish Vashisht, representing Sengar, told the Court that his client required urgent attention for a retinal issue, which necessitated both cataract surgery and laser therapy.

On the other hand, Advocate Mehmood Pracha, who was representing the complainant, opposed the application for interim bail. He argued that the Court had already declined to extend Sengar’s medical bail before and should not allow further extensions.

Despite the opposition, Justice Chawla responded with a reassuring remark, saying, “Even if the Court had denied further extension of bail, heavens will not fall if he is allowed. He can surrender back the same day.”

As a result, the Court granted interim bail to Kuldeep Singh Sengar until January 27, 2025. This bail order came in light of Sengar’s ongoing appeal to challenge his conviction in the Unnao rape case.

Meanwhile, Sengar’s application for the suspension of his sentence in the case related to the custodial death of the victim’s father was also up for hearing. Justice Vikas Mahajan granted the victim’s counsel some time to respond to the plea.

The Court made it clear that it was not inclined to delay the hearing of the case.

“I have certain things to place before the Court,”Advocate Pracha informed, leading to the Court deferring the hearing of the matter until January 31, 2025.
