[Unnao Rape Case] Delhi High Court Grants Interim Bail To Kuldeep Singh Sengar For Medical Treatment At AIIMS-Delhi

Justice Pratibha M. Singh ordered that Sengar be admitted to the All India Institute of Medical Sciences (AIIMS) in Delhi for an initial assessment to determine if his condition could be treated locally or if he would need to be referred elsewhere.

NEW DELHI: The Delhi High Court granted medical bail on Thursday (5th Dec) to Kuldeep Singh Sengar, the former Bharatiya Janata Party (BJP) MLA and convict in the Unnao rape case, allowing him to undergo treatment for retinal detachment.

Justice Pratibha M. Singh ordered that Sengar be admitted to the All India Institute of Medical Sciences (AIIMS) in Delhi for an initial assessment to determine if his condition could be treated locally or if he would need to be referred elsewhere.

The Court granted interim bail for two weeks, with Sengar to be admitted to AIIMS Delhi for a 3-4 day assessment. AIIMS was tasked with evaluating whether his condition could be treated in Delhi. If Sengar is discharged, he must reside at a known location and avoid contacting the survivor. Local CBI authorities will coordinate with AIIMS to monitor his movements, and Sengar must remain in contact with the Investigating Officer daily.

Senior Advocate Narayanan Hariharan argued that Sengar’s medical condition was critical, requiring immediate treatment, including surgery for retinal detachment. He also mentioned that Sengar had other health issues and wished to undergo treatment in Chennai.

On the other hand, Advocate Mehmood Pracha, representing the survivor, opposed the bail application. He argued that Sengar could receive adequate medical care in prison and questioned the validity of his medical reports. Pracha also raised concerns about the safety of the survivor and her family, who are under Central Reserve Police Force (CRPF) protection, given Sengar’s potential threat to them.

The survivor, who was allegedly kidnapped and raped by Sengar between June 11 and June 20, 2017, was also sold for Rs 60,000 and later recovered at the Maakhi police station. She faced continuous threats from police officials, warning her against speaking out.

The case gained national attention after a lorry without a number plate rammed into the car carrying the victim, critically injuring her and her lawyer while killing two of her aunts.

In August 2019, the Supreme Court transferred four cases related to the Unnao rape to Delhi, ordering that the trial be conducted on a day-to-day basis and completed within 45 days.

Sengar was convicted in December 2019 for the rape of the minor and for the custodial death of the survivor’s father. He was sentenced to life imprisonment in the rape case and received a 10-year sentence for the custodial death.
