Union Minister Sukanta Majumdar has filed a writ petition in the Calcutta High Court, alleging repeated “illegal and arbitrary detentions” by West Bengal authorities and seeking judicial protection against violations of his constitutional rights.
Union Minister of State for Education Sukanta Majumdar submitted a writ petition to the Calcutta High Court, contesting what he describes as repeated “illegal and arbitrary” detentions by state authorities, in violation of constitutional protections.
The petition, filed through his legal representatives, outlines several instances of unlawful restrictions and detentions by the police, allegedly executed with a blatant disregard for due process and the fundamental rights outlined in Articles 14, 19, and 21 of the Constitution of India.
Through this petition, Majumdar is seeking several key reliefs from the High Court:
- A Writ of Mandamus instructing state authorities to adhere strictly to the constitutional and legal framework when managing political protests or engagements involving the petitioner.
- Directions for an impartial, high-level investigation into the repeated illegal detentions of the petitioner, to be conducted by a senior police officer with a rank no lower than Additional Director General.
- Disciplinary measures against the police officers responsible for these unlawful actions.
- A Writ of Certiorari to request all relevant records and documents concerning the petitioner’s unlawful detention on June 28, 2025, along with similar occurrences, to ensure justice.
- An injunction prohibiting authorities from interfering with the petitioner’s liberty and movement without due process.
- Mandatory orders for the government to publish and enforce Standard Operating Procedures (SOPs) for the lawful and respectful treatment of public representatives.
The petition also calls for interim reliefs, including immediate protection of the petitioner’s fundamental rights and prevention of future illegal actions.
Majumdar has emphasized through this legal endeavour that the ongoing misuse of police power for political vendetta is intolerable in a democratic republic governed by the rule of law.
This action aims not only to defend his rights but also to uphold democratic values and the constitutional rights of all public representatives.
