The Delhi High Court granted interim relief to Allcargo Logistics, restraining use of the mark ‘VRS ALLCARGO’ or similar variants, holding it likely to confuse consumers and amount to trademark infringement and passing off.

New Delhi: The Delhi High Court granted interim relief in favour of Allcargo Logistics Limited, restraining a competing logistics company from using the mark ‘VRS ALLCARGO‘ or any other confusingly similar variation.
The Court held that such use was likely to mislead the public and constituted trademark infringement as well as passing off.
Justice Tejas Karia noted that the defendants’ adoption of the impugned mark prima facie violated Allcargo’s registered rights over the trademark “ALLCARGO,” which the company has been using for decades. The Court observed that the defendants appeared to be unfairly capitalizing on Allcargo’s established market reputation in the logistics sector.

The Court observed that,
“Material placed on record also shows that Defendant No. 1 has adopted and used the Impugned Marks in a manner that incorporates the Subject Mark ‘ALLCARGO’ in its entirety. The details of registration placed on record also demonstrate that the Plaintiff has secured statutory protection for the Subject Mark ‘ALLCARGO’ including the Word Mark ‘ALLCARGO’ across multiple classes. These registrations establish that Subject Mark ‘ALLCARGO’ is enjoyed by the Plaintiff also as a standalone registered Word Mark,”
Concluding that Allcargo had established a strong prima facie case, and that the balance of convenience favoured the company, the Court restrained the defendants, their associates and representatives from using “VRS ALLCARGO” or any deceptively similar expression for logistics services.

Additionally, the Court directed the concerned domain registrar to suspend and block the websites www.vrsallcargopackers.com, www.vrsallcargopackers.in, and www.vrsallcargo.in within 24 hours of receiving the order. The case has been scheduled for further hearing on March 17, 2026.
Allcargo had approached the Court alleging that VRS All Cargo Packers and Movers Private Limited had started providing logistics and relocation services using the disputed marks through various platforms, including the above websites. It claimed that these services overlapped with its own and were promoted through identical trade channels.
The company further asserted that it has been using “ALLCARGO” since the early 1990s and owns numerous trademark registrations across various classes. Owing to decades of continuous use, high revenue, and extensive promotion, the mark has acquired distinctiveness and strong goodwill, the plaintiff stated.

Since the defendants did not appear despite being served, the Court proceeded to evaluate the material on record and held that the disputed marks were visually, phonetically and structurally similar to Allcargo’s registered marks. It added that an average consumer was likely to assume an association between the two entities, especially as both offered identical services through similar platforms.
Justice Karia also emphasized that Allcargo was the prior user and had built significant goodwill over the years, and the defendants’ use of “ALLCARGO” as the dominant element of their mark was sufficient to establish a likelihood of confusion.
Allcargo Logistics Limited was represented by Senior Advocate Swathi Sukumar, along with advocates Himanshu Deora, Rishika Aggarwal, Sanat Saswadkar, Ritik Raghuwanshi, Murthy, and Pratibha Singh from King Stubb & Kasiva Advocates & Solicitors.
