Telangana High Court Grants Anticipatory Bail to Man Accused of Rape on False Promise of Marriage, Citing 6-Year Consensual Relationship

The Telangana High Court granted anticipatory bail to a man accused of rape on a false promise of marriage. The Court noted their 6-year-long relationship and partial completion of the investigation.

Telangana High Court Grants Anticipatory Bail to Man Accused of Rape on False Promise of Marriage, Citing 6-Year Consensual Relationship

Hyderabad: The Telangana High Court granted anticipatory bail to a man who was accused of rape on the false promise of marriage.

The case was filed under Section 69 of the Bharatiya Nyaya Sanhita (BNS) and Section 67 of the Information Technology Act, 2000, which relates to punishment for sharing obscene content online.

Earlier, the Sessions Court had denied his bail, but the High Court changed that decision and granted him relief with certain conditions. The court observed that both the complainant and the accused knew each other since 2019 and had been in a relationship for nearly six years.

As per the complaint, the woman met the accused while she was studying for her degree in 2019. She said the man promised to marry her and developed a physical relationship with her.

Later, on December 24, 2024, he allegedly took her to his home, had physical relations with her, and secretly recorded her private videos and photos without telling her. When she got pregnant, he allegedly forced her to take abortion pills.

Later, when their families arranged their engagement for February 2, 2025, the accused reportedly refused to marry her. The woman then said that from February 6, 2025, the man started sending her private videos and photos to her friends, relatives, colleagues, and even to her Instagram contacts. After her complaint, a police case was registered under the above-mentioned laws.

The lawyer representing the accused, Mr. Mohd. Adnan, told the court that all the accusations were false and done with wrong intentions. He pointed out that the case was filed after nearly six years of the relationship, which makes the complaint suspicious.

He also said that the investigation’s main part had already been completed, and there is no need to keep the accused in custody.

The accused also assured the court that he would fully cooperate with the police investigation and follow any conditions the court would give.

After hearing both sides, the Telangana High Court decided to grant anticipatory bail. While doing so, the court clearly said:

“The petitioner and the complainant are known to each other since 2019, and the material part of the investigation has already been completed.”

The accused was represented by Advocate Mohd. Adnan from Tripaksha Litigation.

Speaking on the court’s decision, Shonee Kapoor, Partner at Tripaksha Litigation, said:

“We thank honourable High Court for granting relief of Anticipatory Bail. In cases where relationship has spanned years, police should not immediately arrest without verifying authenticity of allegations. I welcome this judgment as a much-needed victory in the fight against false accusations. Too often, we have seen men lose their dignity, careers, and even freedom due to baseless allegations. This judgment proves that the law cannot be a tool for personal vendetta.”

As per the bail order, the court gave the following directions:

  • The accused must surrender to the Jeedimetla Police Station by April 4, 2025.
  • Once he surrenders, police should release him on a personal bond of Rs 50,000, with two sureties of the same amount.
  • He must visit the police station every Monday at 11:00 AM for eight weeks, starting April 7, 2025.
  • He must cooperate with the police and follow all the rules under Section 438(2) of CrPC / Section 482 of BNSS.

The High Court gave this judgment on March 26, 2025, and with this decision, any other pending applications related to this case were also closed.
