NEW DELHI: The Delhi High Court on Friday transferred the plea challenging the arrest of Delhi Chief Minister Arvind Kejriwal’s close aide Bibhav Kumar in the Swati Maliwal assault case to the roster bench hearing cases involving Members of Parliament and Members of Legislative Assemblies (MPs/MLAs). This move indicates the judiciary’s intent to handle cases involving high-profile political figures with the appropriate judicial oversight.

The matter was listed today before Justice Navin Chawla, who indicated that the case would be heard by the judge responsible for MP/MLA matters, given that the complainant is a Rajya Sabha member. Specifically, Justice Swarana Kanta Sharma is the designated roster judge for criminal cases involving current or former MPs/MLAs.

“The transfer of the case is subject to orders of the High Court Acting Chief Justice. The matter is likely to be heard today itself by Justice Sharma,”

Kumar, who stands accused of assaulting the Rajya Sabha Member of Parliament (MP) at Delhi Chief Minister Arvind Kejriwal’s official residence, has approached the High Court seeking to have his arrest declared illegal and to obtain compensation for the same. Kumar has also urged the High Court to declare his arrest in violation of the guidelines set forth by the Supreme Court in the Arnesh Kumar judgment.

Kumar had previously been denied bail by Delhi’s Tis Hazari Court on May 27. He was arrested by the Delhi Police on May 18 and was subsequently remanded to police custody for five days. On May 24, he was transferred to judicial custody.

Swati Maliwal, a leader of the Aam Aadmi Party (AAP), filed the FIR stating that Kumar assaulted her by hitting her in the chest, stomach, and pelvic area with his legs. AAP has vehemently denied these allegations, accusing Maliwal of participating in a conspiracy against the political party.

Earlier, some videos surfaced on social media showing Maliwal having an argument with security personnel and walking out of the Chief Minister’s residence on the day of the alleged assault. These videos have fueled the ongoing controversy and have led to widespread public and media attention.

This case underscores the complexity and sensitivity of legal proceedings involving high-profile political figures and the need for careful judicial handling to ensure justice and maintain public confidence in the legal system.
