Justice Neena Bansal Krishna rejected the plea filed by Kumar.
The court reserved the order on Kumar’s plea on July 8 after hearing arguments on behalf of both sides.
Kumar, currently in judicial custody, allegedly assaulted Maliwal at Kejriwal’s official residence on May 13. He was arrested on May 18.

He was arrested on May 18. The FIR against Kumar was registered on May 16 under Indian Penal Code provisions related to criminal intimidation, destruction of evidence, assault or criminal force on a woman with the intent to disrobe and attempt to commit culpable homicide.
His bail plea was earlier dismissed by the trial court and the high court and is pending before the Supreme Court.
Yesterday in Apex Court
The Supreme Court on Thursday issued a notice to Delhi Police regarding a bail plea filed by Bibhav Kumar, an aide of Aam Aadmi Party leader and Chief Minister Arvind Kejriwal. Mr. Kumar was arrested in May following allegations of assault by AAP MP Swati Maliwal inside Mr. Kejriwal’s residence.
The next hearing is scheduled for August 7.
Previously, Bibhav Kumar was denied bail by both the Delhi High Court and a trial court. Currently in judicial custody until July 16, Mr. Kumar faces charges of criminal intimidation, assault or criminal force on a woman with intent to disrobe, attempt to commit culpable homicide, disappearing evidence, and giving false information.
During a brief hearing this morning, the court noted,
“we normally grant bail… we grant bail to murderers and killers.”
However, the court also expressed reservations, stating,
“look at the FIR. She (Ms. Maliwal) was crying (during the assault)”
and seemed unconvinced by arguments that Bibhav Kumar, if granted bail, would not influence witnesses. The bench of Justices Surya Kant, Dipankar Datta, and Ujjal Bhuyan remarked,
“If this kind of person can’t influence who can? Was anyone in the drawing room (of the Chief Minister’s home, where the alleged assault began) to speak against him… he doesn’t seem ashamed, we think.”
The court also made a particularly strong observation by calling Mr. Kumar a “goon.”
Senior advocate Abhishek Singhvi, representing Mr. Kumar, questioned the delay by Ms. Maliwal in filing her complaint. He referred to Ms. Maliwal’s visit to Delhi’s Civil Lines Police Station on May 13 (the day of the alleged assault) and highlighted the “strange story” in her FIR.
