[Swati Maliwal Assault Case] HC Asks Police stand on Kejriwal aide Bibhav Kumar’s Bail plea

A vacation bench led by Justice Amit Sharma has issued a notice on the bail plea and instructed the Delhi Police to submit a status report.

NEW DELHI: Today (14th June): The Delhi High Court directed the police to provide their stance on the bail application of Bibhav Kumar, an aide to CM Arvind Kejriwal, who is accused of assaulting AAP Rajya Sabha MP Swati Maliwal.

A vacation bench led by Justice Amit Sharma has issued a notice on the bail plea and instructed the Delhi Police to submit a status report.

Bibhav Kumar, currently in judicial custody, stands accused of assaulting Swati Maliwal on May 13 at Chief Minister Arvind Kejriwal’s official residence. Kumar was taken into custody on May 18.

Kumar’s bail plea has been previously rejected twice by the trial court, which cited the seriousness of the charges and concerns about potential witness tampering.

Kumar argued in his plea to the high court that his continued custody was unnecessary since the investigating officer had completed evidence collection and recorded witness statements. The initial rejection of his bail application on May 27 by a sessions court emphasized the absence of premeditation in Maliwal’s FIR and underscored the serious nature of the allegations.

On June 12th, Bibhav Kumar, a former aide to Delhi Chief Minister Arvind Kejriwal, has approached the Delhi High Court seeking regular bail in the alleged assault case involving Swati Maliwal.

Recently, Delhi’s Tis Hazari Court rejected Kumar’s regular bail plea, citing threats received by the victim, Swati Maliwal, and concerns that Kumar might influence witnesses.

The FIR against Kumar, registered on May 16, includes charges under various sections of the Indian Penal Code related to criminal intimidation, assault on a woman with the intent to disrobe, and attempt to commit culpable homicide.

Kumar is accused of assaulting Maliwal at the Chief Minister’s residence in New Delhi on May 13. According to Maliwal’s allegations, Kumar used abusive language against her and “brutally assaulted” her, dragging and banging her head on a center table when she was waiting at the CM’s official residence.
