New Delhi: The legal battle over the will of late industrialist Sunjay Kapur has reached the Delhi High Court, where strong arguments were raised by the minor son of his widow Priya Kapur against the plea filed by actor Karisma Kapoor’s children.

The children have challenged the authenticity of their father’s alleged will, but the opposing side has called their case weak and based purely on assumptions.

During the hearing, the counsel for Priya Kapur’s six-year-old son clearly stated that there was no delay in producing the will.

He explained that Sunjay Kapur passed away on June 12 and the will was presented by the executor in a meeting held on July 30. This, according to him, was a normal timeline and not an unreasonable delay.

He strongly criticised the claims made by Karisma Kapoor’s children, stating,

“This entire case is based on speculation and guesswork. Their case is that on July 30, the executor reads it out hurriedly, slashes a document, and reads it out selectively. At that point, they admittedly know three things — date, witnesses, and that they are excluded,”

as submitted by senior advocate Akhil Sibal before Justice Jyoti Singh.

Sibal further informed the court that after the July 30 meeting, there was no communication from Karisma Kapoor’s children asking for a copy of the will. He said the first formal request was made only on August 22.

He also pointed out that Karisma Kapoor was actively coordinating with Priya Kapur to complete documentation while the will issue was already known. Explaining this, he said,

“In between, the mother (Karisma Kapoor) of the plaintiffs readily communicates with defendant 1 (Priya Kapur) to get all the paperwork finished. She is asking for the documents, and defendant 1 is cooperating… They don’t get the copy of the will as they refused to sign the confidentiality agreement.”

He further argued that the children were fully aware they were excluded from the will, and their legal move was simply a strategy to challenge it.

He told the court,

“They are excluded, and they know the legal strategy is to challenge the will, whether the will is genuine or not, they must challenge,”

adding that the case was filed only because they were aware they were not beneficiaries.

Continuing his submission, Sibal stated that the plaintiffs could have clearly said that the will appeared suspicious due to the lack of access, but instead they chose to challenge it forcefully. He explained this position by saying,

“But they knew they were excluded, so they had to challenge it (will) come what may”.

On the issue of Sunjay Kapur’s foreign assets, the counsel clarified that the matter does not fall under Indian jurisdiction and no valid case had been made by Karisma Kapoor’s children in this regard.

He also mentioned that there was no bitterness between the families when Sunjay was alive and all interactions were cordial.

Earlier, Priya Kapur had also made her stand clear in court, stating that it was normal practice for a husband to leave his assets to his wife, and she denied all allegations of suspicious circumstances around the will.

The court is currently hearing the suit filed by Karisma Kapoor’s children, Samaira Kapur and her minor brother, who have challenged the legality of the will involving assets reportedly worth Rs 30,000 crore.

The Delhi High Court has also taken up an interim injunction application, where the children have requested that Priya Kapur be restrained from dealing with or transferring the assets until the matter is resolved. The case has now been listed for further arguments next week.

Sunjay Kapur passed away on June 12 after collapsing during a polo match in England, reportedly due to sudden cardiac arrest. The legal dispute over his vast estate continues to draw significant attention as both sides firmly stand by their respective claims.
