The proceedings on Thursday highlight multiple irregularities surrounding the documents presented.
Senior advocate Mahesh Jethmalani raised serious concerns about the validity of the will and the evidence submitted. He questioned the sudden shift from emails to WhatsApp communications as proof, highlighting inconsistencies and gaps.
“They even spoke about signed wills, the message was acknowledged by Priya, not Sunjay. If you look at Dinesh’s phone, there’s no group chat name or numbers. The ‘SK will’ message was only seen, not read. This is an uncertified and suspicious document. It’s strange they’ve shifted from emails to WhatsApp chats. He certified only the emails, not the chats. No electronic evidence certificate has been filed. These WhatsApp documents are fabricated screenshots come from two different phones. Where’s the consistency?”
Jethmalani also criticized the content of the will itself, pointing out glaring omissions and inconsistencies:
“The contents are absurd. It says ‘all my assets,’ yet several assets aren’t even disclosed.”
The court sought clarification on the existence of prior wills. Counsel representing the estate stated:
“Not as far as we’re aware.”
According to Jethmalani, the handling of the will after Sunjay Kapoor’s cremation raised further suspicion.
“After Sunjay’s cremation, D4 visited his home. The original will was handed over to D4 by D1—that itself is contradictory. There was a race to hand it to the executor on that solemn day. We’ve received a copy but haven’t seen the original yet. The executor named in this ₹30,000 crore estate was never even told of her appointment. The executor has been passive, accepting the form of execution by R1. Even the daughter’s address is wrong—it’s Karishma Kapoor’s office address.”
He also questioned the credibility of the document in terms of style and attention to detail:
“Such blunders are completely out of character for Mr. Kapoor. He shared a close bond with his children. How could he have gotten his daughter’s address wrong and misspelled his son’s name several times in the will? This will trivializes and demeans the late Sunjay Kapoor—it’s written in an unusually casual manner. This will is riddled with glaring errors. It lacks details about several assets, including jewellery and crypto holdings. This isn’t a document prepared, read, or made by Sunjay Kapoor. There’s no proof that anyone other than Defendant No. 1 and others were behind it.”

Background
In a high-profile family dispute, the children of Bollywood actor Karisma Kapoor and late businessman Sunjay Kapur have approached the Delhi High Court seeking their share in their father’s estimated Rs 30,000 crore estate.
The children alleged that Priya Kapur, Sunjay Kapur’s third wife, had forged his will to claim complete control over the assets, leaving them unfairly excluded. The disputed will, dated 21 March 2025, reportedly bequeaths the entire estate solely to Priya Kapur.
The suit names Priya Kapur, her minor son, Sunjay Kapur’s mother Rani Kapur, and the executor of the will, Shradha Suri Marwah, as defendants. The children claim that Priya, along with associates Dinesh Agarwal and Nitin Sharma, concealed the will for over seven weeks and disclosed it only at a family meeting on 30 July 2025.
They have argued that the will is forged and fabricated, citing suspicious circumstances and refusal to provide them with a copy. Through their petition, the children seek:
- Declaration as Class I legal heirs under the Hindu Succession Act.
- Partition of the estate, granting each child a one-fifth share.
- Interim freezing of all personal assets of Sunjay Kapur to prevent misuse.
The petition was filed by Shantanu Aggarwal of Lexster Law LLP and Madhulika Rai Sharma.
