Trademark Battle: Sun Pharma Wins Major Relief as Bombay High Court Bars Zawadi Healthcare From Using Similar Drug Name Pantozed

The Bombay High Court ruled in favour of Sun Pharma in a trademark dispute over Pantocid. The court restrained Zawadi Healthcare from using Pantozed, citing risk of confusion in medicines.

MUMBAI: In a recent trademark dispute between Sun Pharma and Zawadi Healthcare over drug names, the Bombay High Court ruled in favour of Sun Pharma. Sun Pharma has been marketing a medication for acidity and other stomach problems under the brand name Pantocid since 1998.

They discovered that Zawadi Healthcare was producing a similar medicine in India and labeling it Pantozed. Sun Pharma approached the Bombay High Court, arguing that their long use of the Pantocid name has built consumer trust and that Pantozed sounds almost identical to Pantocid. This resemblance, they contended, could mislead doctors, pharmacists, or patients a serious risk when it comes to medicines.

Zawadi Healthcare countered that the prefix “Panto” derives from the generic name Pantoprazole, so it should not be exclusively owned by any one company. They also stated that their product was manufactured in India solely for export to Kenya, where the name had already been registered.

The court temporarily restrained Zawadi Healthcare from using the name Pantozed. The decision underscores that using similar names can constitute trademark infringement. In the medical context, even minimal confusion is hazardous because a patient could receive the wrong medication. Sun Pharma therefore won this stage of the legal battle to protect its brand.

Pantocid Tablet belongs to a group of drugs called proton pump inhibitors (PPIs). These medicines primarily reduce the amount of acid produced in the stomach. Proton pump inhibitors (PPIs) are drugs that substantially decrease stomach acid production by blocking the tiny proton pumps in the stomach lining that secrete acid into the digestive tract.

They are used to treat acid-related conditions affecting the stomach and intestines, such as heartburn, acid reflux, and peptic ulcers. PPIs relieve symptoms and promote healing.

Uses of PPIs : PPIs are commonly prescribed for conditions including:

  • Gastroesophageal Reflux Disease (GERD): Relieves heartburn and acid reflux symptoms.
  • Peptic Ulcer Disease: Helps heal stomach and intestinal ulcers by lowering acid levels.
  • Esophagitis: Treats inflammation of the esophagus caused by acid exposure.
  • Zollinger-Ellison Syndrome: Manages a rare disorder in which the stomach produces excessive acid.
