Rajasthan High Court Stays Quashing of Sub-Inspector Recruitment Exam 2021: Major Relief for Candidates

RAJASTHAN: The Rajasthan High Court has provided temporary relief to candidates who cleared the 2021 sub-inspector (SI) recruitment exam, after a single-judge bench had earlier scrapped the process, citing a paper leak scandal.

On Monday, a division bench comprising Justices Sanjeev Prakash Sharma and Sanjeet Purohit stayed the order of August 28, which had annulled the recruitment. The stay was granted while hearing an appeal filed by Vikram Panwar, a candidate who successfully cleared the examination.

The Case

The 2021 recruitment drive, conducted by the Rajasthan Public Service Commission (RPSC), advertised 859 posts of sub-inspector and platoon commander. However, allegations of a paper leak and irregularities soon emerged, prompting the state government to hand over the investigation to the Special Operations Group (SOG) of the Rajasthan Police. The probe resulted in the arrest of over 50 trainee sub-inspectors and other accused individuals.

Following the investigation, a single-judge bench of the High Court quashed the entire recruitment process on August 28. This decision was challenged by candidates like Panwar, who argued that innocent aspirants should not be penalized for the misconduct of a limited number of individuals.

Arguments Before the Bench

Counsel for the appellant stressed that:

  • Only a limited number of candidates were implicated in the paper leak.
  • Cancelling the entire process would cause irreparable harm to honest candidates who cleared the exam on merit.
  • Scrapping the recruitment could discourage faith in public examinations.

The state cabinet’s sub-committee had also submitted a report recommending against cancellation of the exam, echoing concerns about punishing innocent candidates.

Court’s Interim Relief

The division bench, while acknowledging the gravity of the allegations, stayed the effect of the single-judge order. This means that, for now, the recruitment process remains intact and will not face immediate disruption.
