The Court noted that the issues raised demand thorough examination, indicating that the case will require in-depth discussion.

During the hearing, Justice Vikas Mahajan’s bench allowed the parties involved to submit short written statements to clarify any points from their initial arguments.

Rani Kapur, the mother of the late industrialist Sunjay Kapur, has brought the case to court questioning the conditions under which the RK Family Trust was formed and managed.

In her suit, she claims that the trust was established and operated without her informed consent, leading to her exclusion from the beneficial ownership of assets she believes originally belonged to her.

The plaintiff asserts that these events unfolded while she was medically incapacitated after a stroke and relied on her son to handle her personal and financial matters. She contends that she was assured her assets remained under her control and were being managed for her benefit.

The suit further claims that her late son was either manipulated or allowed himself to be used in setting up the trust arrangement. Rani Kapur believes she was misled into thinking her estate was secure based on assurances given to her, even as transactions were allegedly conducted that negatively impacted her ownership rights.

She additionally alleges that documents were signed without her fully understanding their contents or legal ramifications, with some signed in blank.

These claims are directed at Priya Kapur and other defendants, who are accused of hiding the true nature and implications of the trust structure.

Through her legal action, Rani Kapur seeks to have the RK Family Trust cancelled and her estate restored, asserting that the transactions were a result of misrepresentation and undue influence and occurred without her informed consent.

Earlier, Rani Kapur, initiated legal action in the Delhi High Court to cancel the Rani Kapur Family Trust.

This trust holds a significant stake in Sona Comstar, an automotive component manufacturer, with its value estimated in the thousands of crores.

A separate case regarding the control of Sunjay Kapur’s assets is already before the Delhi High Court.

In her lawsuit, the 80-year-old Rani Kapur has claimed that the trust was established fraudulently and has been used to remove her from her entire estate, including her influence over the Sona Group of companies. She has accused Priya Kapur, Sunjay Kapur’s widow, of being the “chief mastermind” behind the alleged conspiracy.

Rani Kapur alleges that Priya Kapur acted quickly after Sunjay Kapur’s death to take control of crucial Sona Group companies without notifying her.

The lawsuit asserts that after Rani Kapur suffered a stroke in 2017, her late son Sunjay Kapur and his third wife, Priya Kapur, manipulated her physical dependence and trust to execute a complicated scheme that transferred all her assets to the RK Family Trust without her informed consent.

Rani Kapur has named 23 entities as defendants in the case, including Priya Kapur and seven of her grandchildren, two of whom are children of Bollywood actress Karisma Kapoor.

Background of the Case

The personal estate dispute of late industrialist Sunjay Kapur has been pending before the Delhi High Court for several months and forms the background to the ongoing inheritance battle within his family. The case involves conflicting claims by his widow, Priya Sachdev Kapur, his mother Rani Kapur, and his children from his earlier marriage with actor Karisma Kapoor, namely Samaira Kapur and Kiaan Raj Kapur.

The dispute began after Sunjay Kapur’s children and his mother approached the High Court alleging that the will relied upon by Priya Kapur was forged.

They challenged its validity and claimed that it does not reflect Sunjay Kapur’s true intentions regarding his multi-million-dollar personal estate. As part of the civil proceedings, they sought an interim injunction to prevent Priya Kapur from dealing with or managing the estate until the issue is finally decided.

During the hearings, Priya Kapur denied all allegations of forgery and concealment of assets, while Sunjay Kapur’s mother questioned the disclosure of his income and bank balances.

Previously, Priya Kapur’s son challenged the authenticity of the will purportedly belonging to their father, opposing the claims made by Karisma Kapoor’s children and asserting that their challenge was founded on “speculation and guesswork.”

Earlier, On November 20, Priya Kapur informed the High Court that it is a customary practice for a husband to leave all his assets to his wife, countering the assertion made by Karisma Kapoor’s children that their father’s alleged will emerged under questionable circumstances.

The High Court had previously allowed Priya Sachdev Kapur to file a list of Sunjay Kapur’s movable and immovable assets in a sealed envelope. Justice Jyoti Singh was reviewing her request to submit these asset details confidentially, along with a commitment that neither party would share this information with the media.
