RG Kar Case Verdict || Calcutta High Court to Hear CBI, Victim’s Family, and Convict Before Deciding State’s Appeal

Today, On 22nd January, The Calcutta High Court will hear the CBI, the convict, and the victim’s family before deciding on the West Bengal government’s appeal concerning the sentence in the RG Kar hospital rape-murder case. The government argues the trial court’s sentence was inadequate, while the CBI opposes the state’s right to appeal, asserting its role as the prosecuting agency. The case will be taken up on Monday, with all parties presenting their arguments. The hearing aims to address the state’s challenge and ensure a fair review of the sentence.

Kolkata: The Calcutta High Court announced on Wednesday that it would hear the Central Bureau of Investigation (CBI), the victim’s family, and the convict before making a decision on the West Bengal government’s appeal regarding the sentence deemed inadequate by a trial court in the RG Kar hospital rape-murder case.

The court scheduled the hearing for Monday.

The CBI contested the state’s right to file an appeal, arguing that it, as the prosecuting agency, should be the one to raise concerns about the inadequacy of the sentence.

On Monday, the Sealdah court sentenced the convict, Roy, to life imprisonment until death for the rape and murder of an on-duty doctor at RG Kar Medical College and Hospital on August 9.

A division bench led by Justice Debangshu Basak stated that it would hear from the CBI, the victim’s family, and the convict through their legal representatives before deciding on the admission of the state’s appeal.

On August 9 last year, a 31-year-old junior doctor was raped and murdered at the state-run RG Kar Hospital in Kolkata. Her body was discovered in the hospital’s seminar room. The incident sparked nationwide outrage and led to prolonged protests by junior doctors in West Bengal, demanding justice and improved security at government hospitals.

The trial began on November 11, three months after the incident, in a Kolkata court. The Central Bureau of Investigation (CBI), which took over the case from the Kolkata Police following a directive from the Calcutta High Court, has sought the “maximum punishment” for Roy. The trial concluded on January 9.

Sanjay Roy, a civic volunteer with Kolkata Police, was convicted on Saturday for the rape and murder of a junior doctor at RG Kar Medical College and Hospital in Kolkata. The crime, which occurred on August 9, triggered nationwide outrage over women’s safety. The verdict, delivered by Anirban Das, Additional District and Sessions Judge of the Sealdah court, came 57 days after the in-camera trial commenced on November 12.
