Today, On 24th January, The CBI approached the Calcutta High Court, seeking the death penalty for Sanjay Roy, convicted in the RG Kar hospital rape-murder case. The High Court is set to hear the appeal on January 27, alongside a similar plea from the West Bengal government. Roy was previously sentenced to life imprisonment by the Sealdah court. The case continues to draw attention due to its severity and legal implications.

Kolkata: The Central Bureau of Investigation (CBI) filed an appeal with the Calcutta High Court, requesting the death penalty for Sanjay Roy, the convict in the RG Kar hospital rape-murder case.

A division bench led by Justice Debangsu Basak scheduled a hearing for the CBI’s appeal on January 27, alongside a request from the West Bengal government to admit its own appeal with a similar plea.

The CBI’s appeal, presented by Deputy Solicitor General Rajdeep Majumdar, argues that the agency, which investigated the case, is entitled to challenge the trial court’s sentence due to its inadequacy. On January 20, the Sealdah court had sentenced Roy to life imprisonment until the end of his natural life for the rape and murder of an on-duty doctor at RG Kar Medical College and Hospital on August 9, 2024.

The division bench indicated on Wednesday that it would hear arguments from the CBI, the victim’s family, and the convict through their respective lawyers before deciding on the admission of the state government’s appeal.

The CBI contested the state’s right to file an appeal, asserting its position as the prosecuting agency entitled to address the issue of sentence inadequacy.

Advocate General Kishore Dutta, representing the state, argued before the court that a life sentence for Roy was inadequate, seeking capital punishment instead.

On August 9 last year, a 31-year-old junior doctor was raped and murdered at the state-run RG Kar Hospital in Kolkata. Her body was discovered in the hospital’s seminar room. The incident sparked nationwide outrage and led to prolonged protests by junior doctors in West Bengal, demanding justice and improved security at government hospitals.

The trial began on November 11, three months after the incident, in a Kolkata court. The Central Bureau of Investigation (CBI), which took over the case from the Kolkata Police following a directive from the Calcutta High Court, has sought the “maximum punishment” for Roy. The trial concluded on January 9.

Sanjay Roy, a civic volunteer with Kolkata Police, was convicted on Saturday for the rape and murder of a junior doctor at RG Kar Medical College and Hospital in Kolkata. The crime, which occurred on August 9, triggered nationwide outrage over women’s safety. The verdict, delivered by Anirban Das, Additional District and Sessions Judge of the Sealdah court, came 57 days after the in-camera trial commenced on November 12.
