Delhi High Court Refers AAP MLA Vishesh Ravi's Election to Larger Bench

NEW DELHI: The Delhi High Court made a crucial decision by referring a petition challenging the election of AAP MLA Vishesh Ravi from the Karol Bagh constituency to a larger bench. This move has reignited political discussions in Delhi and brought election laws into the spotlight.

Background of the Case

The petition was filed in February 2020 by BJP leader Yogender Chandolia, who contested against Vishesh Ravi in the Delhi Assembly elections. Chandolia alleged discrepancies in Ravi’s educational qualifications as declared in his nomination affidavit.

Specifically, the BJP leader claimed that Ravi’s statement about passing the Class 10 examination through the National Institute of Open Schooling in 2003 was false. Chandolia sought to have the Karol Bagh election result nullified, citing Ravi’s alleged misrepresentation.

Delhi High Court’s Observations

In its recent hearing, Justice Subramonium Prasad referred the matter to a larger bench, stating:

“I am not inclined to agree with the view of the coordinate bench.”

Earlier, in December 2020, the court refused to dismiss Chandolia’s petition, noting that the MLA’s educational claims were inconsistent. The court also highlighted that a false declaration regarding educational qualifications could potentially be treated as a corrupt practice under the Representation of the People Act, 1951.
