This observation came during the hearing of a case titled Ramdev v. State of UP, where the Court firmly refused to grant bail to the accused man.
The matter was heard by Justice Ajay Bhanot, who underlined how modern-day crimes are evolving with technology.
The judge stated:
“Digital technology is altering the face of crime. Indecent pictures of a person when circulated on public platforms by social media can destroy lives. This is the hard social reality.”
The accused in this case was arrested in January 2025, after allegedly circulating a woman’s private images via WhatsApp. He had filed a bail application in the High Court after a lower court rejected his plea in April 2025.
However, the High Court refused to give him bail. The Court took note that some images were found with the accused and that these images were yet to undergo forensic testing. This evidence pointed to the accused’s possible involvement in the serious offence under the Bharatiya Nyaya Sanhita, 2023 and Section 67A of the Information Technology Act, 2000.
The Court made it clear:
“The FSL report is awaited. The offence is grave. There is likelihood that the applicant had committed the offence. At this stage, no case for bail is made out.”
While rejecting the bail, the Court also made sure to balance justice. It stressed that the trial should be completed quickly, without unnecessary delay. It ordered the lower court to carry out all necessary steps under the law to make sure witnesses are present and the case moves forward efficiently.
The Court further noted:
“The trial court has also to be conscious of the rights of the accused persons and is under obligation of law to ensure that all expeditious, necessary and coercive measures as per law are adopted to ensure the presence of witnesses. Counsels or parties who delay or impede the proceedings should not only be discouraged from doing so but in appropriate cases exemplary costs should also be imposed on such parties/ counsel.”
It also reminded the authorities that earlier directions had already been issued to make sure that summons to accused and witnesses are properly served. The Court expressed concern over delays due to lawyers’ strikes and asked all concerned to follow the rules so that trials don’t get delayed.
To further ensure speed in the case, the High Court directed the District Judge to keep a close watch on the case’s progress:
“The learned District Judge is directed to take weekly reports of the progress of the trial … Without going into the merits of the case, the bail application is dismissed … The trial judge shall submit a fortnightly report on the progress of trial and the steps taken to comply with this order to the learned District Judge.”
In this matter, Advocates Satyam Mishra and Shailendra Singh represented the accused.
