Justice Sameer Jain has set the next hearing for February 10 after the state’s Additional Advocate General Vigyan Shah presented the case.
According to Vedant Sharma, who represents the accused candidates currently working as sub-inspectors, the government has not yet made a decision about cancelling the recruitment exam. The court has stressed that no changes should be made to the recruitment or training process during this time. It has also appointed senior advocate RD Rastogi as an amicus curiae to help resolve the issue.
On the other hand, Harendra Neel, a lawyer representing those who want the exam cancelled, pointed out that the government has delayed its decision because the investigation is not yet complete. Additionally, a cabinet committee led by Parliamentary Affairs Minister Jogaram Patel is currently reviewing the matter.
“The government did not follow the order”
Explaining the situation, Rajasthan High Court advocate Harendra Neel said,
“On November 18, the Rajasthan High Court had ordered to maintain status quo in this recruitment process, but the government is not following this order. This matter was raised in the court and we also said that all the agencies have said that the recruitment should be canceled. SOC, Police Headquarters, AG sahab and even cabinet ministers have given their opinion on this, but still the government is not taking a decision on it. On one hand the government is not taking a decision in this and on the other hand they are being given field postings. The court has clearly considered it as its contempt.”
“There should be no contempt of court order”
Advocate Neel further elaborated,
“The court, understanding the seriousness of the matter, commented that the status quo order should be followed completely so that there is no contempt of the order. The court strictly warned the government that no change or alteration should be made and the status quo should be kept as it is. The next hearing of the case is on January 9, in which it will be seen whether the court’s order is being followed by the government or not. In this entire matter, the petitioners hope that the court will take strict action on this and issue a directive to the government to follow the High Court’s order.”
Hearing on field posting of trainee SIs
In addition to the recruitment issue, the court also reviewed a petition against the Rajasthan Police Headquarters’ directive to send trainee Sub-Inspectors (SIs) to districts for field training. During this hearing, Justice Sameer Jain’s bench ruled,
“It was also said that the status quo should be maintained, trainee SIs should remain where they have been posted and no changes should be made.”
The ongoing case reflects significant tension, as the government is under pressure to comply with the High Court’s orders while managing demands from both sides of the dispute. The court will closely monitor if the status quo is maintained in upcoming hearings.
