NEW DELHI: The Delhi High Court today heard a request from Bharatiya Janata Party (BJP) leader Subramanian Swamy. He had asked the court to give orders to the Ministry to cancel the Indian citizenship of Congress leader Rahul Gandhi.

The lawyer representing the Union Government told the court that they had already filed a response.

The court noticed that no lawyer was present for the petitioner.

Court:

“Dismiss case to May 28, 2025”.

PREVIOUSLY IN DELHI HC

Delhi High Court, on February 19, 2025, questioned the Union Government about why they had not yet replied to Subramanian Swamy’s request. Swamy had asked for Rahul Gandhi’s Indian citizenship to be canceled because he claimed that Gandhi is a British citizen.

A group of judges, including Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela, told the lawyer representing the Union Government and Additional Solicitor General (ASG) Chetan Sharma to find out what the status of Swamy’s request was. The court fixed the next hearing date for March 26, 2025.

Earlier, in December 2024, the court had sent a notice regarding Swamy’s case. Swamy’s lawyer, Satya Sabharwal, informed the court that they had already given all necessary documents to the concerned authorities. He also asked the court to issue a notice to the Union Government, stating that even after many attempts and court appearances, the Ministry had not taken any action.

Swamy’s petition mentioned that in August 2019, he had filed a complaint against Rahul Gandhi. Swamy claimed that Gandhi had told the British Government that he was a British citizen, which meant he must have had a British passport. Because of this, on April 20, 2019, the Ministry had sent a notice to Gandhi with the title ‘Complaint regarding citizenship‘. Swamy argued that even after many requests for updates, the Ministry had not given any reply.

At the same time, another case was filed in the Allahabad High Court. This case was filed by S. Vignesh Shishir, who also questioned whether Rahul Gandhi could be a Member of Parliament (MP) because of the same foreign citizenship issue.

However, the Allahabad High Court rejected this case.
