He was accused of sharing edited videos that allegedly showed Prime Minister Narendra Modi and Home Minister Amit Shah in a negative light.
While hearing the bail plea, Justice NS Shekhawat of the High Court noted that the doctor had already spent considerable time in custody, and the investigation in the case was nearly over.
The Court allowed bail, saying:
“The prosecution is yet to lead evidence to prove the involvement of the petitioner in the crime. At this stage, nothing is to be recovered from the petitioner and the investigation is almost complete. Even otherwise, the petitioner is a senior citizen and deserves sympathetic consideration. Thus, the further custody of the petitioner will not serve any useful purpose,”
The police had earlier claimed that the videos shared by the doctor showed Indian leaders and the Indian Army “in a subdued state,” while Pakistani leaders were shown as victorious.
According to the police, the video was shared at a time when India and Pakistan were facing heightened tensions after a terror attack in Pahalgam.
The authorities argued that such content could fuel separatist sentiments and threaten the sovereignty, unity, and integrity of the nation.
However, the doctor’s lawyer told the Court that his client had only forwarded the video and did not create it. He said there was no evidence to prove that the accused had any direct connection with the alleged crime.
The lawyer also mentioned that the doctor is a senior citizen who suffers from multiple age-related health problems and deserves leniency.
Mushtaq Ahmed was represented in court by Senior Advocate Bipin Ghai, along with Advocates Nikhil Ghai and Paras Talwar.
The State of Haryana was represented by Additional Advocate General Rupinder Singh Jhand.
CASE TITLE:
Mushtaq Ahmed v State of Haryana.
