Trademark & Copyright Battle Over Party Flag| Madras HC Notice to TVK’s Vijay, Hearing After Six Weeks

CHENNAI: The Madras High Court has issued a notice to Tamilaga Vettri Kazhagam (TVK) leader Vijay regarding a legal dispute over the use of the party flag. The notice follows an appeal filed by the Chennai-based trust, Thondai Mandala Saandror Dharma Paribalana Sabai, challenging a previous order by a single judge.

The single judge had earlier, on August 18, declined to restrain TVK from using its party flag. Dissatisfied with this decision, the Dharma Paribalana Sabai approached the division bench seeking relief.

A division bench comprising Justices G Jayachandran and M Sudheer Kumar has now posted the matter for further hearing after six weeks.

The crux of the dispute lies in allegations of trademark and copyright infringement. Thondai Mandala Saandror Dharma Paribalana Sabai claimed that TVK’s use of its party flag infringed upon its intellectual property rights. The Sabai had originally filed an application arising out of a suit, seeking to restrain TVK from using the flag, but the single judge declined to grant the injunction.
