[MUDA Scam] Karnataka HC Adjourns Hearing of CM Siddharamaiah’s Plea Related To Transfer Of Cases Till Dec 10

Karnataka: The Karnataka High Court today (26th Nov) has postponed until December 10 the hearing on a petition seeking the transfer of the MUDA site allotment scam investigation to the CBI.

The petitioner stated that they had no faith in the Lokayukta police and requested the case be handed over to the CBI.

The case involves allegations that compensatory plots were allocated to Parvathi, the wife of Chief Minister Siddaramaiah, in a prime area of Mysuru, which had a higher property value than the land she had “given” to MUDA. The MUDA had allotted plots to her under a 50:50 scheme in exchange for 3.16 acres of her land, which was used for a residential development.

The controversial scheme allowed MUDA to allocate 50 percent of the developed land to landowners in exchange for undeveloped land used to create residential layouts. It is claimed that Parvathi did not have legal ownership of the 3.16 acres at survey number 464 of Kasare village in Mysuru. Both the Karnataka Lokayukta police and the Enforcement Directorate are investigating the matter, though the Chief Minister has denied any involvement in the alleged scam.

On August 19, Siddaramaiah approached the High Court to challenge the legality of the Governor’s order. In his petition, the Chief Minister argued that the sanction order was issued without proper consideration, in violation of statutory requirements, and against constitutional principles, including the binding advice of the Council of Ministers under Article 163 of the Constitution of India.

Siddaramaiah sought the quashing of the Governor’s order, asserting that it was legally untenable, procedurally defective, and influenced by improper motives.
