Madras High Court Stands Firm on Actress Jayaprada’s Conviction in ESI Payment Case

The Madras High Court, in a significant judgment, has reinforced the conviction of renowned actress and former Member of Parliament, Jayaprada, in a case related to the non-payment of Employees’ State Insurance (ESI) contributions. This decision underscores the judiciary’s commitment to ensuring strict adherence to statutory obligations concerning employee welfare.

Jayaprada, celebrated for her roles in cinema and her tenure in politics, also served as the director of a private company. This company was thrust into the limelight when discrepancies were found in its ESI payments, which are mandatory for the welfare of its employees. Given the critical nature of ESI contributions, which provide essential medical and cash benefits to employees and their families, any default is viewed as a grave breach of both legal and ethical duties by employers.

Following her conviction by a lower court, Jayaprada’s legal team sought relief from the Madras High Court. However, Justice V. Bharathidasan, who presided over the case, was unequivocal in his stance. He emphasized the importance of ensuring workers’ welfare and stated,

“The offense is against the welfare legislation intended to give benefits to the workers.”

He further highlighted that the non-payment of contributions affects the rights of workers, which is a grave matter.

In a decisive move, Justice Bharathidasan directed Jayaprada to deposit a sum of Rs. 20 lakh to seek bail in the case, emphasizing the gravity of the offense and the need for strict adherence to legal obligations, especially concerning workers’ welfare.

This judgment by the Madras High Court serves as a potent reminder to all employers about the importance of adhering to statutory requirements. It underscores the judiciary’s unwavering commitment to upholding the rights of workers and ensuring they receive the benefits and protections they are entitled to under the law. The case also reiterates that no individual, regardless of their status or achievements, is exempt from their legal obligations.
