Allahabad High Court: “Live-In Relationship Goes Against Women’s Interest”

The Allahabad High Court observed that live-in relationships harm women more, as men can easily remarry after breakups. The Court stated, “Live-in relationship goes against the interest of the women…” while granting bail in a rape case.

The Allahabad High Court recently noted that deteriorating live-in relationships often lead to legal disputes, as such arrangements clash with the values of Indian middle-class society.

This remark was made while the Court was granting bail to a man accused of sexually exploiting a woman under the False promise of marriage.

A Bench led by Justice Siddharth stated that since the Supreme Court ‘legalized’ live-in relationships, the number of related cases has surged in the courts.

The Court remarked,

“This Court finds that after live-in-relationship has been legalized by the Apex Court, the Court had fed up such cases. These cases are coming to the Court because the concept of live-in-relationship is against the settled law in the Indian Middle Class Society (sic),”

The judge remarked that women endure greater hardships than men when live-in relationships come to an end.

Justice Siddharth observed,

“The concept of live-in-relationship goes against the interest of the women since a man can marry even after live-in-relationship (with) a woman or number of women but it is difficult for the women to find a life partner after a breakup,”

This statement was made during the hearing of a bail application by Shane Alam, who faces multiple charges under the Bharatiya Nyaya Sanhita, 2023 (BNS), and the Protection of Children from Sexual Offences Act (POCSO Act).

He allegedly engaged in a sexual relationship with the victim based on a false promise of marriage, which he later retracted.

The informant’s attorney, Madhu Yadav, contended that the accused’s actions had devastating effects on the victim’s life, making it challenging for her to find a suitable marriage partner.

The Court acknowledged that while the younger generation is drawn to live-in relationships, the negative consequences can be clearly observed in cases like this one.

Ultimately, the Court granted bail to the accused. Advocate Satish Chandra Singh represented the bail applicant.
