The Delhi High Court summoned a Sub-Inspector from Gurugram’s Economic Offences Wing after a financial services company alleged that Investigating Officer SI Sanjay threatened its representatives and behaved rudely with their lawyer when she tried serving a notice on him.

NEW DELHI: The Delhi High Court has summoned a Sub-Inspector (SI) from the Economic Offences Wing in Gurugram following claims from representatives of a financial services company that he issued threats after they sought the Court’s intervention.
The company alleged that Investigating Officer (IO) SI Sanjay had exhibited rude behavior towards its lawyer via phone when she attempted to serve him with a notice regarding a petition filed for de-freezing their bank account.
These concerns were brought to the Court’s attention in an application for an expedited hearing of the petition.
On March 11, Justice Jasmeet Singh noted that it would not be possible to hear the case prior to the previously scheduled date of April 10.
The Court stated,
“The roster of this Court does not permit a date earlier than 10.04.2026. It shall be the endeavour of the Court to take up the matter on the date already fixed,”
Nevertheless, the Court summoned the IO accused of threatening the petitioner and the lawyer.
The Court ordered,
“Mr. Sanjay Kumar, Investigating Officer, is directed to remain present in Court on the next date of hearing,”
The petition was filed by Shanky Financial Services (the petitioner) against the Reserve Bank of India, a bank, and the EOW. The main concern raised was about a lien placed on the petitioner’s bank account, which the company claimed had halted its operations and left it unable to pay its employees.
In its application for an early hearing, the petitioner asserted that on March 7, SI Sanjay visited the company’s office and threatened them, instructing them to withdraw their petition for the de-freezing of their bank account. The company claimed that SI Sanjay warned them that failing to comply would result in being implicated in false and frivolous cases. CCTV footage from the visit was submitted as evidence.
The company contended that the EOW officer made it a “prestige issue” and questioned why they approached the Delhi High Court instead of the Punjab and Haryana High Court.
Additionally, the company referenced a previous incident where SI Sanjay allegedly misbehaved with its lawyer last month. A separate affidavit documenting this incident was filed by the lawyer, Advocate Tanisha Bhatia.
In her affidavit, Bhatia detailed her encounter with SI Sanjay when she attempted to serve advance copies of the company’s petition, as mandated by the Delhi High Court Rules. She stated that SI Sanjay responded rudely during a phone call, using very abusive language. The remarks made by the SI were described as derogatory by the lawyer.
According to her, SI Sanjay stated:
“Tum mujhe copy kyu bhej rahi ho main ni aaunga, Delhi High Court hai to kya hua? Tum mere department ko serve karvao mujhe dobara bhejna mat or jab court se aaega tab main dekhunga.”
(Translation: “Why are you sending me a copy? So what if it’s the Delhi High Court? Serve my department. Don’t send it to me again. When the Court sends it to me, I will see.”)
Consequently, arrangements were made to serve the notice to the Commissioner of Police of EOW, Gurugram, rather than directly to the IO.
The Court has now formally summoned the IO to appear in person when the case is reviewed in April. “Let the notice be served to Mr. Sanjay Kumar, through D.C.P, Gurugram, using all methods including electronic means, with the petitioner taking steps within one week from today, returnable on 10.04.2026,” the Court ordered.
