This decision came despite objections from the management of Shahi Idgah Masjid, which had argued that the suits were barred by the Places of Worship Act, the Limitation Act, and the Specific Relief Act.
Justice Mayank Kumar Jain rejected the application moved by the Muslim side, thereby allowing the Hindu parties to proceed with their suits. The Hindu side claims that the Mathura Shahi Idgah Masjid was constructed over the Krishna Janmabhoomi land and seeks the mosque’s removal. They argue that there are various indications suggesting that the Shahi-Idgah Mosque is, in fact, a Hindu temple.
The dispute originated with an original suit filed by the Hindu side. In December last year, the High Court had permitted an application by the Hindu deity Bhagwan Shri Krishna Virajman and seven other Hindu parties to appoint a court commissioner to inspect the Shahi-Idgah mosque. However, this direction was subsequently stayed by the Supreme Court.
The case had initially been dismissed by a civil court in September 2020, which cited the Places of Worship (Special Provisions) Act, 1991, as a bar to admitting the case. This decision was overturned upon appeal before the Mathura District Court in May 2022. The District Court found the suit to be maintainable and reversed the civil court’s dismissal.
In 2023, the proceedings were transferred from the trial court to the High Court, where the recent ruling by Justice Jain has now affirmed the Hindu side’s right to pursue their suits. The next steps in this legal battle will be closely watched, as it touches upon sensitive issues of religious heritage and legal interpretations of historical claims.
BACKGROUND
The entire controversy centers around the Shahi Eidgah mosque in Mathura, which dates back to the era of Mughal emperor Aurangzeb. The mosque is alleged to have been built after demolishing a temple at the birthplace of Lord Krishna.
In 1968, a ‘compromise agreement’ was reached between the Shri Krishna Janmasthan Seva Sansthan, the temple management authority, and the Trust Shahi Masjid Eidgah. This agreement allowed both places of worship to operate simultaneously. However, the validity of this agreement has been questioned by various parties seeking relief through the courts regarding the Krishna Janmabhoomi.
The litigants argue that the compromise agreement was fraudulent and legally invalid. Many claim the right to worship at the disputed site and have sought the removal of the Shahi Eidgah mosque. They assert that the agreement does not hold legal ground and have filed suits to challenge it.
In May of last year, the Allahabad High Court decided to transfer all the pending suits from the Mathura court to itself. These suits, brought forward by Bhagwan Shrikrishna Virajman and seven others, seek various forms of relief related to the Krishna Janmabhoomi-Shahi Eidgah Mosque dispute.
The High Court’s recent ruling affirmed the maintainability of 18 suits filed by the Hindu side, rejecting the objections raised by the management of Shahi Idgah Masjid. Justice Mayank Kumar Jain’s decision allows the Hindu parties to continue their legal battle, which includes claims that the mosque was constructed on Lord Krishna’s birthplace after demolishing a temple.
