The victim’s parents had petitioned the court for a monitored investigation, while several PILs also called for a CBI probe into the matter.
During the hearings, Chief Justice T.S. Sivagnanam, leading a division bench with Justice Hiranmay Bhattacharyya, noted deficiencies in the probe. They questioned whether the statement of Sandip Ghosh, the then principal of the medical college, had been recorded, which the state lawyer confirmed had not been done.
The Chief Justice of the Calcutta High Court remarked,
“Principal Sandeep Ghosh of RG Kar Medical College must go on leave today. If he does not comply, I will issue an order. Has his statement been recorded?”
The court also directed,
“Principal Ghosh’s resignation letter from RG Kar Medical College and his appointment letter as the new principal of National Medical College must be submitted together by 1 pm.”
The Chief Justice noted that as the principal, Ghosh is accountable for the staff at the hospital and questioned, “If he cannot show empathy, who will?”
The court further stated,
“The former principal should be at home, not employed elsewhere.”
The postmortem report of the trainee doctor, who was raped and murdered at RG Kar Medical College and Hospital, indicated she had endured “perverted sexuality” and “genital torture.”
In response to several PILs regarding the rape and murder incident at RG Kar Medical College and Hospital, the Chief Justice division bench of the Calcutta High Court raised concerns about the reappointment of the principal, who had resigned from RG Kar Medical College on moral grounds.
The court questioned how this principal could be appointed to another government college and demanded that he submit a leave application by 3 pm today, or face a court order for removal from his position.
The court also remarked that, despite holding an administrative role, the principal should have been among the first to be questioned. It criticized the state counsel for protecting him and ordered that his statement be recorded.
Additionally, the Chief Justice division bench directed the submission of the case diary related to the incident by 1 pm today.
