The Allahabad High Court has stayed the suspension of ACP Mohammad Mohsin Khan in a sexual harassment case. The court has asked the UP government to respond by July 28.
Lucknow: Today, On May 12, The Allahabad High Court has temporarily stopped the suspension of Assistant Commissioner of Police (ACP), Kanpur, Mohammad Mohsin Khan.
He was earlier suspended in connection with a sexual harassment case. This decision was taken on Monday by the Lucknow bench of the High Court.

Justice K S Pawar, who heard the case, gave this temporary relief to ACP Khan and also asked the Uttar Pradesh government to reply to the petition.
The court has now fixed the next hearing of the case on July 28.
The suspension of ACP Mohammad Mohsin Khan had been challenged by him through a legal petition. In this petition, he questioned the legality and fairness of the suspension order passed by the state government.
After reviewing the initial facts and arguments, the court decided to stay the suspension until the next hearing.
The judge passed an “interim stay” on the suspension order. This means that for now, the suspension will not be in effect until the court makes a final decision after the hearing on the fixed date.
The petition filed by ACP Khan claimed that the suspension was done in a “hurried and arbitrary manner”, without giving him a fair chance to explain his side.
His legal team also argued that the action taken against him was
“not in accordance with the law and principles of natural justice.”
Justice K S Pawar, while passing the order, directed the Uttar Pradesh government to present its version before the court and to “file its reply” to the petition.
This reply will be important in helping the court make a final decision in the matter.

The High Court has now posted the matter for the next hearing on “July 28”, where both sides will be heard in detail.
ACP Mohammad Mohsin Khan had moved the High Court seeking relief and justice, saying that his suspension was unfair and had caused damage to his career and reputation.
The court’s decision to stay the suspension comes as a temporary relief to him, while the legal process continues.
As per the court’s present decision,
“The interim stay came on Khan’s plea challenging his suspension order.”

This case will now be closely followed, as the High Court will take a final view after receiving the government’s response. Until then, the suspension order will remain on hold.
