Today in turn of events that has captured the attention of legal fraternity, Justice Abhijit Gangopadhyay of the Calcutta High Court extended a heartfelt apology to the state’s Advocate General, Kishore Dutta.
This gesture came in the wake of a heated exchange that unfolded in open court on January 25, during the hearing of a case concerning alleged irregularities in MBBS recruitment, which Justice Gangopadhyay had directed to be investigated by the CBI. This directive was issued despite a previous ruling by a division bench led by Justice Soumen Sen, which had decided against such a probe. In his written order, Justice Gangopadhyay went as far as to level accusations against Justice Sen, sparking controversy and leading to calls for an apology.
The incident prompted over 250 lawyers, including members of various Bar associations, to pen a letter to Calcutta High Court Chief Justice T S Sivagnanam, expressing their concerns over the altercation and urging Justice Gangopadhyay to issue an apology. The letter detailed the events of January 25, describing how Justice Gangopadhyay, upon being informed of the division bench’s order from the previous day, reacted with intense anger, making “extremely uncharitable, demeaning, and defamatory comments” about the Advocate General. These remarks were characterized as “unprovoked and uncalled for,” crossing the boundaries of judicial decorum by casting aspersions on the character, moral fiber, and integrity of the Advocate General.
Addressing the matter, Justice Gangopadhyay invited Advocate General Kishore Dutta to his court, where he expressed his regret over the incident.
“Just a few days back I have said a lot of things to you. I have known you for years. For nearly the last 37 years. I am apologetic to you. I am very very sorry,”
Justice Gangopadhyay stated, acknowledging his anger and the harsh words he had uttered. “Everyone in the Bar must know. I am apologetic,” he added, signaling a public acknowledgment of his actions and an attempt to mend the rift.
The lawyers’ letter underscored the significance of maintaining the honor and dignity of the court, emphasizing that the high court represents more than just a physical structure; it is a foundation built on the time-honored traditions of mutual respect and cordiality between the bar and the bench.
In response to the unfolding situation, Chief Justice of India D Y Chandrachud took decisive action by assembling a bench comprising himself and four senior judges.
