Goa: On June 10, 2023, the Anjuna-Caisua Panchayat issued a public notice to the owners or occupants of 175 structures situated in the Coastal Regulation Zone (CRZ) and No Development Zone (NDZ) area. The notice mandates the submission of essential documents, such as construction licenses or permissions issued by the Panchayat, within the next five days. This action aligns with Section 66 of the Goa Panchayat Raj Act and is in compliance with a High Court Order dated April 26, 2023.

“The concerned occupants/owners, having structures/cottages/restaurant etc., are hereby called upon to produce the construction license/permissions before the Village Panchayat Anjuna-Caisua within 5 days of the publication of this notice,”
states the notice.

Section 66 of the Goa Panchayat Raj Act
Building construction requires written permission from the Panchayat, with fees. If the Panchayat doesn’t decide in 30 days, an appeal can be made to the Deputy Director. Unauthorized construction can be halted by the Panchayat, with the option to issue a demolition notice. Non-compliance leads to expenses at the owner’s cost. If the Panchayat fails to act, the Deputy Director takes over. The Block Development Officer can stop rule-violating construction. Appeals against orders can be made to the Director within 30 days, with the Director’s decision being final.

It further emphasizes that failure to produce the required documents will result in appropriate action being taken by the Panchayat under the Goa Panchayat Raj Act, as directed by the Hon’ble High Court.

In a significant turn of events, the High Court of Bombay at Goa has issued a categorical order to seal the 175 structures found operating unlawfully within the Coastal Regulation Zone (CRZ) and No Development Zone (NDZ) in the Anjuna area.

The division bench of the High Court has specifically instructed the Anjuna Panchayat and the Directorate of Panchayat to promptly seal these establishments, thereby bringing an immediate halt to all operations, with the assistance of the police.

As part of this judicial directive, the Court has mandated the submission of a compliance report within the next ten days, underlining the urgency and seriousness of the situation.

The proactive measures taken by the Anjuna-Caisua Panchayat, guided by the High Court’s directives, are aimed at upholding the rule of law and maintaining the ecological balance in the region.
