The Delhi High Court granted bail to a film director after a woman admitted she falsely accused him of rape. The Court warned that fake sexual offence cases hurt both innocent people and real victims.

False Rape Complaints Must Be Dealt Harshly: Delhi High Court Warns of Damage to Real Victims

NEW DELHI: The Delhi High Court raised serious concern over the rising number of false sexual offence complaints, calling for strict action in such cases to protect the innocent and maintain trust in the justice system.

While hearing a bail plea of a film director who was earlier accused of rape, Justice Girish Kathpalia noted that false allegations not only destroy the life of the falsely accused person but also deeply harm genuine victims of sexual crimes.

The Court strongly stated:

“This is yet another case, reflecting the recent trend of lodging false complaints of sexual offences. Every false complaint of sexual offences not just causes immense damage to the person accused of the offence, but also creates cynicism and distrust across the society, which leads to even the genuine victims of sexual offences suffer, as society starts suspecting her truthful complaint also to be false. Such false complaints have to be dealt with sternly.”

This sharp remark came while the Court was considering the bail application of a film director, who was accused of rape by an aspiring actress. The woman had earlier filed a complaint that the director sexually exploited, blackmailed, and raped her.

However, during the police investigation, the truth unfolded. The woman withdrew her accusations, saying that there had never been any rape and that she and the director had been in a mutual relationship for five years. She admitted that she was provoked by the director’s enemies to file a fake rape case against him.

The woman also submitted a legal affidavit in the High Court, clearly stating that her earlier allegations were false.

Taking this new evidence into account, the Delhi High Court granted bail to the film director.

Further, the police informed the Court that they had already started the legal process to register a criminal case against the woman and others involved in planning and filing the false rape complaint.

Representing the film director were Senior Advocate Amit Chadha, along with Advocates Hirein Sharma, Aamir Chaudhary, Hayas Singh, Sarthak Sethi, and Sakshi Yadav.

Additional Public Prosecutor Nawal Kishore Jha appeared for the State.
