Ranchi, Jharkhand : The Jharkhand High Court annulled the letter from Eastern Coalfields Limited that denied employment to a woman, stating that such denial violated Articles 14 and 15 of the Constitution of India.
The Court was addressing a Writ Petition filed by the petitioner, who sought employment as a land loser of 5.06 acres and contested the refusal letter.
Justice Sanjay Kumar Dwivedi remarked,
“The denial of employment to the female candidate is against the provisions of Articles 14 and 15 of the Constitution of India.”
Advocate Mahesh Tewari represented the appellant, while Advocate Amit Kumar Das represented the respondent.
Background
In this case, the land of the petitioner’s father was utilized for coal extraction by Eastern Coalfields Limited. Following a legal struggle, the father’s petition was approved, leading the Court to dismiss Eastern Coalfields’ appeal and instruct the company to provide compensation and employment to the petitioner’s family.
However, despite the Court’s final ruling, Eastern Coalfields did not comply and issued a letter denying employment while offering compensation instead. The Court noted that the counter affidavit mentioned that in exceptional cases where there is no male nominee, Eastern Coalfields Limited was considering proposals for female employment. Consequently, denying employment based on gender is contrary to the mandate of the Constitution of India.
