NEW DELHI: In the ongoing case concerning the alleged larger conspiracy behind the 2020 Delhi riots, the Delhi High Court today re-notified the bail plea of Umar Khalid, a prominent accused, for hearing on October 7.

The Delhi High Court was set to hear the bail plea of ​​Umar Khalid, who stands accused in the Delhi violence case, today. The hearing was scheduled to be conducted by a bench led by Justice Suresh Kait.

This follows the High Court’s issuance of a notice to Delhi Police on July 24.

Notably, Justice Amit Sharma had recused himself from hearing Umar Khalid’s bail plea earlier on July 22.

To provide context, the Karkardooma Court had previously rejected Umar Khalid’s bail plea on May 28.

During that hearing, Umar Khalid’s representative, Trideep Pais, argued that the Delhi Police was using Khalid’s name in the charge sheet “as if it is a mantra.” Pais emphasized that

“repeatedly mentioning his name in the charge sheet and lying will not make any fact true.”

Pais also highlighted that

“a media trial was conducted against Umar Khalid.”

He insisted that, when deciding on bail,

“the court will have to examine every witness and document.”

Drawing parallels to the Bhima Koregaon case involving Vernon Gonsalves and Shoma Sen, he demanded bail for Umar Khalid.

On the other side, Special Public Prosecutor Amit Prasad, representing the Delhi Police, argued that during the bail plea hearing,

“it cannot be said that there are many irregularities in the investigation.”

He emphasized that

“this is not a plea for discharge from the charges.”

In terms of Umar Khalid’s defense, he has maintained that there are

“more serious allegations against the other accused in this case,”

yet they have been granted bail, and in some instances, the Delhi Police had “not even made them accused.” Trideep Pais, advocating for Khalid, pointed out that

“the facts on the basis of which bail was given to the three accused are the same with Umar Khalid as well.”

Citing the principle of equality, Pais demanded bail for Khalid, further noting that

“no section of the terror law has been applied against Umar Khalid.”

It is worth noting that Umar Khalid had previously withdrawn his bail plea from the Supreme Court, opting instead to file a petition in the trial court. Khalid was arrested under the Unlawful Activities Prevention Act (UAPA) in connection with the alleged conspiracy behind the 2020 Delhi riots. He remains incarcerated. Earlier, on October 18, 2022, the Delhi High Court had rejected another of Umar Khalid’s bail pleas.

This development marks another significant step in the judicial process surrounding one of the most contentious cases in recent years.

Umar Khalid, who has been under detention since his arrest under the Unlawful Activities Prevention Act (UAPA), continues to challenge the denial of bail amidst growing concerns over the legal proceedings and the charges levied against him.

The upcoming hearing on October 7 will be closely watched, as it could potentially alter the course of Khalid’s legal battle and the broader narrative of the Delhi riots case.
