NEW DELHI: The Delhi High Court today (22nd Oct) rejected the bail application of Shahrukh Pathan, who was recorded aiming a firearm at a police officer during the riots in Northeast Delhi in 2020.

Justice Dinesh Kumar Sharma ruled against the plea, despite Pathan’s lawyer arguing that he had already spent four years in jail and the maximum penalty is ten years since no injuries were reported.

BRIEF FACTS

The case is documented under FIR 51/2020 and includes serious charges such as rioting and attempted murder. These accusations arise from the Jafrabad riots, which occurred amid anti-CAA protests, during which Pathan allegedly discharged a weapon at a police officer. The incident was captured on video and received extensive media coverage.

In the aftermath of the riots, police found three empty cartridges labeled KF 7.65 at the scene. Following the shooting, Shahrukh Pathan allegedly evaded capture in Delhi before eventually fleeing to Shamli, Uttar Pradesh, where he was apprehended by the Delhi Police Crime Branch.

During his interrogation, Pathan revealed that the vehicle he used belonged to his uncle’s son and had been abandoned in a garage in Haryana after it broke down. The clashes in February 2020 in northeast Delhi, which pitted pro- and anti-CAA groups against each other, led to at least 53 deaths.

On December 14, 2023, a trial court also denied Pathan bail, citing concerns regarding his conduct and the testimony from witnesses along with video evidence. The court emphasized the gravity of the charges and the incident’s repercussions.

Following the incident, Pathan fled to Shamli in Uttar Pradesh, where he was apprehended by the Delhi Police Crime Branch. During interrogation, he disclosed information about the vehicle used for his escape, which belonged to a relative and was abandoned in Haryana.

The violent clashes in Northeast Delhi in February 2020, which involved both pro- and anti-CAA factions, led to 53 fatalities, underscoring the severity of the riots.
