Delhi High Court Seeks Police Status Report On AAP Worker’s Plea Against Deputy CM Parvesh Verma

New Delhi: The Delhi High Court on Thursday issued notice to Delhi Deputy Chief Minister Parvesh Verma and the State of Delhi, and asked Delhi Police to file a status report, on a petition by Aam Aadmi Party (AAP) worker Sahib Singh. The petitioner alleges that he was slapped and assaulted by the minister during an inspection of road construction work, and seeks an independent probe and police protection for himself and his family [Sahib Singh v. State (NCT of Delhi) and Others].

Justice Sachin Datta heard the matter. The allegations are those of the petitioner, they remain untested, and the Court has expressed no view on their merits.

The petitioner’s case

Sahib Singh states that on 27 September he was accompanying AAP MLA Jarnail Singh to inspect road construction work along the Outer Ring Road in West Delhi, where the MLA had raised concerns about alleged substandard material. He alleges that Verma slapped, abused and assaulted him, that his phone containing recordings was seized and damaged, and that an unidentified person struck him in his private parts. He also states that he has since received threats.

The petitioner complained at the Vikas Puri police station, and a non-cognizable report (NCR) was registered under Section 115(2) of the Bharatiya Nyaya Sanhita. He contends that the NCR does not cover all his allegations. He seeks police protection and an independent probe, and asks the Court to consider a judicially supervised inquiry committee headed by a former High Court judge to examine the allegations, CCTV footage, electronic evidence and police records.

The other side

Counsel for the respondents told the Court that the plea is not maintainable. Outside court, after the incident, Verma said he would not tolerate attempts by AAP workers to obstruct government officials, and alleged that the petitioner is associated with AAP and has a previous case against him. The Delhi BJP expressed regret over the incident and made similar claims about the petitioner. The Public Works Department separately lodged a complaint at the Tilak Nagar police station against MLA Jarnail Singh, alleging obstruction of officials in the discharge of their duties.

The AAP has alleged that the road work was substandard and has accused Delhi Police of acting against its leaders instead of acting on its demand for an FIR against the minister. All of these contentions are disputed and none has been tested by the Court.

What the Court did

The Court issued notice to Verma and the State of Delhi and directed Delhi Police to file a status report. The matter will next be heard in November.

Why the order matters

The order is procedural. By issuing notice and calling for a police status report, the Court has asked for the official record of what action has been taken on the petitioner’s complaint, including the NCR, before deciding whether any further step is warranted. It has not granted the protection or the independent probe sought, and it has not examined the truth of the petitioner’s allegations or the respondents’ answers.

The petition raises the question of how a complaint against a serving minister is to be investigated when the complainant says the recorded NCR is incomplete, while the respondents say the plea cannot be entertained at all. That contest will be decided on the status report and the arguments in November.
