New Delhi: The Delhi High Court on Friday declined to take up immediately a plea by the Indian Youth Congress (IYC) challenging the denial of permission to hold a protest at Jantar Mantar against Chief Election Commissioner (CEC) Gyanesh Kumar, and said it would hear the matter on Monday, October 12 [Indian Youth Congress v. Delhi Police].
Senior Advocate Sanjoy Ghose mentioned the matter for the petitioner. The report of the hearing does not name the Bench.
What was said in Court
Mr Ghose told the Court that he had mentioned the matter on Thursday and had been granted liberty to mention it again on Friday if it was not listed. He submitted that the Youth Congress is only seeking permission to demonstrate at Jantar Mantar, a designated protest site.
The Court responded by asking what the urgency was, and said it would hear the matter on Monday.

Background of the plea
The IYC has challenged the Delhi Police’s refusal to permit a demonstration at Jantar Mantar against the CEC. In its plea, it says the application was made for a peaceful demonstration and that the refusal reached it on the first proposed date of the protest. The Delhi Police’s response has not been placed before the Court so far, and no court has examined the grounds of the refusal.
