Delhi High Court Grants Gang-Rape Convict Two Weeks’ Parole For House Repairs After Over 14 Years In Jail

Delhi High Court granted two weeks’ parole for house repairs, citing prolonged incarceration and parole’s reformative purpose, while limiting the decision’s precedential use.

Justice Girish Kathpalia of the Delhi High Court, who granted two weeks’ parole in the Delhi High Court ruling

New Delhi: Justice Girish Kathpalia set aside the rejection of Shahid alias Billi’s parole request in a gang-rape case [Shahid @ Billi v. State (NCT of Delhi)].

House repairs and reform

The authority had found no emergent reason beyond repairs and monetary arrangements. The State defended that refusal.

In paragraph 7, it considered over 14 years’ custody and photographs showing repairs were needed. Refusal, it held, would frustrate parole’s reformative purpose.

Two weeks, with a surrender date

Against a 60-day request, paragraph 8 granted two weeks on a Rs 10,000 personal bond and matching surety. Jail authorities must communicate the surrender date in writing against acknowledgment.

Paragraph 9 cautioned against treating the case as precedent, noting co-convict Usman alias Kale’s release on furlough that day.
