On Monday (19/02/24) Delhi High Court has scheduled a hearing for February 20 regarding the appeal by Shibu Soren, the chief of Jharkhand Mukti Morcha, against the refusal to halt proceedings initiated by the Lokpal. This follows a complaint lodged by BJP MP Nishikant Dubey, alleging corruption and misuse of public funds by Soren and his family. The appeal, which challenges the Lokpal’s decision to proceed with an inquiry based on the allegations, marks a pivotal moment in the ongoing legal battle involving the former Jharkhand Chief Minister.

“Taking into account that the regular bench is not sitting today, list tomorrow,” the bench stated, indicating the urgency and importance of the matter.

Senior advocate Kapil Sibal, representing Soren, highlighted the concurrent listing of the complaint before the Lokpal, emphasizing the critical timing of the court’s review.

“It (appeal) will come in the supplementary list. It will come early,”

the court assured, acknowledging the significance of the proceedings set to unfold.

The heart of the controversy lies in the allegations made by Dubey in August 2020, accusing Soren and his family of amassing wealth through corrupt practices and exploiting public resources. Following these accusations, the Lokpal directed the Central Bureau of Investigation (CBI) to conduct a preliminary inquiry to determine the existence of a prima facie case against Soren.

The court’s previous ruling highlighted the premature nature of Soren’s challenge against the Lokpal’s proceedings, suggesting that the ombudsman should first assess the material evidence before any judicial review. Furthermore, the judge dismissed Soren’s claims of malice in the complaint, underscoring the Lokpal’s role as an independent authority yet to fully examine the evidence provided by the CBI.

This upcoming hearing not only represents a crucial juncture for Soren but also underscores the Lokpal’s role in addressing allegations of corruption at high levels of government. As the legal proceedings continue, the outcome could have significant implications for governance and accountability in India, spotlighting the mechanisms in place to combat corruption and uphold public trust.
