These reports, covering the years 2017-2018 to 2021-2022, are alleged to be pending review by the Chief Minister and Finance Minister, Atishi.
A senior counsel representing the petitioners brought up the case for listing before a bench led by Chief Justice Manmohan. In response, the bench, which also included Justice Tushar Rao Gedela, noted,
“Tomorrow.”
The petition, filed on behalf of Leader of Opposition Vijender Gupta and fellow BJP MLAs Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, Anil Kumar Bajpai, and Jitendra Mahajan, claims that despite repeated requests from the LG, the reports have not been submitted to him for assembly tabling.
This petition, prepared by advocates Neeraj and Satya Ranjan Swain, highlights previous approaches made to the Chief Minister, Chief Secretary, and Speaker, all of which allegedly went unanswered.
The plea emphasizes the critical nature of the reports, arguing that
“This deliberate suppression of vital information not only violates democratic principles but also prevents proper scrutiny of government action and expenditures, raising serious questions about the government’s financial proprietary, transparency and accountability.”
Further, the petition requests the issuance of
“an appropriate writ in the nature of mandamus/certiorari directing the respondent no.2 (Department of Finance) to send a proposal to respondent no.4 (LG) for exercising his duties under Article 151(2) of the Constitution of India, 1950, Regulation 210(1) of the Regulations on Audit and Accounts, 2007 and Section 48 of the Government of National Capital Territory Act, 1991.”
This request underscores the petitioners’ insistence on adherence to constitutional and regulatory mandates regarding the timely presentation and review of public financial documents.
