This decision marks a significant moment in the ongoing investigation into allegations of corruption and malfeasance associated with the excise policy.
Sanjay Singh had previously sought to challenge his arrest, arguing that it constituted an abuse of the legal process and was in contravention of the Supreme Court’s ruling in the “Pankaj Bansal v. Union of India” case, also referred to as the “M3M Reality” case. However, on October 20, 2023, the High Court dismissed this plea, emphasizing the Enforcement Directorate (ED) as a premier investigating body and cautioning against attributing political motives to its actions, which could tarnish the country’s image.
Following the High Court’s rejection, Singh escalated the matter to the Supreme Court, which, on November 20, 2023, granted him the liberty to seek bail from the trial court. Unfortunately for Singh, after the trial court turned down his bail application, he was compelled to file the current plea before the High Court, seeking relief and contesting his continued detention.
The legal team representing Sanjay Singh comprised Senior Advocate Mohit Mathur, along with a cadre of advocates including Rajat Bhardwaj, Mohd Irshad, Harsh Gautam, Ankita M Bhardwaj, Kanishk Raj, and Kaustubh Khanna. On the opposing side, the ED’s interests were defended by Additional Solicitor General (ASG) SV Raju, Special Counsel Zoheb Hossain, and a team of advocates including Vivek Gurnani, Samrat Goswami, Kartik Sabharwal, Pranjal Tripathi, Madhumita, Sonali Sharma, Hitharth, and Kanishk Maurya.
