Delhi HC Slaps Contempt Notice on Man Seeking Judge’s Death Penalty

The Delhi High Court has issued a contempt of court notice to a man named Naresh Sharma, following his plea that contained several unsubstantiated allegations against the judiciary. Sharma had initially filed a plea seeking an investigation into corruption by the Indian government since its independence. However, this plea was rejected by a single-judge on July 27, 2023.

Subsequently, Sharma’s appeals against the judgment were presented before a Division Bench comprising Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula on August 31. Upon examination, the Bench found that the appeals contained numerous whimsical and baseless allegations of criminal acts against both the single-judge and the Supreme Court of India. Notably, Sharma had even demanded the death penalty for government officers, suggesting execution by a firing squad.

The Division Bench expressed its strong disapproval of such allegations, deeming them “unacceptable” and “distasteful.” The court emphasized that these allegations seemed to be deliberately aimed at undermining the authority of the judiciary.

The order explicitly stated,

“In our opinion, the statements have been advanced with the malafide intention to interfere with the administration of justice. This Court cannot disregard vilification of this magnitude against a judge of this Court and the Hon’ble Supreme Court. There is a fine line of distinction which separates critique from allegations fueled by disdain and a hostile intent to scandalize the court. The pleadings in the present appeal amount to the latter category and must be taken cognizance of.”

This incident underscores the importance of maintaining the sanctity and respect for the judiciary, emphasizing that baseless allegations and attempts to malign the court will not be taken lightly.
