Justice Ravinder Dudeja instructed the AAP leaders to submit their response by December 4, concerning Dikshit’s plea challenging a trial court’s decision.
Dikshit filed a revision petition after the trial court dismissed his complaint against the AAP leaders, stating that the alleged defamatory remarks were made during the election and fell under the category of political exchanges.
The Congress leader has filed a revision petition challenging the trial court’s ruling, which dismissed his complaint against AAP leaders. The court stated that the alleged defamatory remarks were made during the election and were part of a trade-off of accusations.
Dikshit’s attorney argued that the allegations were personal and had resulted in reputational and electoral damage for his client, qualifying as defamation.
The court has issued a notice and scheduled the matter for December 4.
In April, the trial court rejected Dikshit’s complaint, emphasizing the AAP leaders’ “legitimate exercise of fundamental right to freedom of speech and expression.”
It declined to acknowledge Dikshit’s complaint, asserting that the statements he deemed defamatory were “not imputation” but rather “political aspirations and assertions.”
It was claimed that during a press conference, Atishi and Singh accused Dikshit of not only accepting “crores of rupees from the BJP, but Congress had also colluded with the ruling party to defeat AAP.”
