'Wholly Cursory Averments' in the Petition: Allahabad HC Dismisses PIL Seeking Protection for Men Harassed by Women

ALLAHABAD: The Allahabad High Court recently dismissed a Public Interest Litigation (PIL) that sought the creation of legal protections for men against alleged harassment and misuse of laws by women. The case was heard by a Division Bench comprising Chief Justice Arun Bhansali and Justice Kshitij Shailendra.

Court’s Reasoning

The Court observed that the petition relied heavily on news reports and lacked detailed, factual submissions. Terming the arguments as “wholly cursory averments,” the Bench concluded that the petition did not meet the threshold required for a PIL. The Court stated:

“No case is made out in the petition for entertaining the same as public interest litigation. The petition is, therefore, dismissed.”

This ruling reflects the judiciary’s consistent approach of requiring concrete evidence and substantial legal reasoning before entertaining PILs.

This is not the first time such petitions have faced rejection. In 2023, the Supreme Court refused to entertain a PIL seeking the establishment of a National Commission for Men to address issues like suicides among married men.

Additionally, following the tragic death of Bengaluru techie Atul Subhash, a PIL was filed in the Supreme Court highlighting alleged misuse of domestic violence and dowry laws, seeking guidelines to prevent harassment of men.
