BURGER SINGH SCAM IN PATNA: Delhi High Court Stops Bihar Outlet From Using Franchise Name After Contract Termination

NEW DELHI: The Delhi High Court passed an interim order stopping a Patna-based outlet from using the brand name ‘Burger Singh‘ or anything that looks or sounds like it. This decision came after the main Burger Singh company filed a case against the outlet for breaking franchise rules.

Burger Singh is a popular food brand that started in 2013. In 2023, the company signed a five-year franchise agreement with a restaurant in Patna, allowing them to use the Burger Singh name and sell products under the same brand.

However, problems began when the Patna outlet did not follow the rules of the agreement. The company found that the outlet was using expired food items, not paying for raw materials, and had even disconnected CCTV cameras which were there to monitor quality and safety.

Because of these serious violations, the main company cancelled the agreement in May 2025.

Even after the contract was cancelled, the Patna outlet continued to use the name ‘Burger Singh‘ and was still selling products under this name. The company told the court that this was confusing customers and hurting the real brand’s image and reputation.

Hearing the case, Justice Jyoti Singh said that there was enough reason to support Burger Singh’s request for temporary relief.

“Having heard learned counsel for the Petitioner, I am of the view that a prima facie case for grant of ex parte ad interim relief is made out by the Petitioner. It is accordingly directed that till the next date of hearing, Respondent shall not use the mark ‘BURGER SINGH’ or any other mark confusingly or deceptively similar thereto for its goods and services,”

With this, the court also appointed a local commissioner to visit the Patna outlet. The court allowed the commissioner to seize and take possession of all things that used the Burger Singh name or logo.

This includes hoardings, posters, menus, catalogues, and letterheads. The commissioner has been asked to submit a full report within two weeks.

The lawyer Advocate Jayant Kumar represented Burger Singh in court.
