NEW DELHI: Today (16th Aug): BJP leader Subramanian Swamy has moved the Delhi High Court, seeking an order to compel the Ministry of Home Affairs (MHA) to act on his request to revoke the Indian citizenship of Congress leader and Lok Sabha’s Leader of Opposition, Rahul Gandhi.
The High Court is expected to hear the matter in the coming week.
The petition, filed by advocate Satya Sabharwal, stems from Swamy’s 2019 letter to the MHA. In his letter, Swamy raised concerns over a company called Backops Limited, registered in the UK in 2003, where Gandhi allegedly held the roles of Director and Secretary.
According to Swamy, in the company’s Annual Returns dated October 10, 2005, and October 31, 2006, Gandhi declared himself as a British national. Further, in a dissolution application for the company filed on February 17, 2009, Gandhi’s nationality was once again recorded as British.
Swamy argues that this conflicts with Article 9 of the Indian Constitution and the Indian Citizenship Act, 1955.
On April 29, 2019, the MHA sought clarification from Gandhi, asking him to provide the factual details within two weeks. However, Swamy contends that more than five years later, the MHA has yet to disclose any decision regarding the matter.
