The Allahabad High Court denied bail to a man accused of forcing his wife into prostitution, citing the grave and traumatic nature of the allegations. The victim’s mother filed an F.I.R. alleging that after marriage, the accused harassed and exploited her daughter, forcing her into illegal activities and subjecting her to abuse by his associates. The accused claimed it was a false case arising from a matrimonial dispute, but the court found the allegations credible and noted that such acts severely harm the victim’s dignity and self-esteem. Considering the seriousness of the charges, the court rejected the bail plea.

UP: The Allahabad High Court dismissed a bail application of a man accused of forcing his wife into prostitution. The court noted that such acts degrade the victim and leave her with a deeply traumatic experience.

The bail application was filed under Section 439 of the Cr.P.C. by the accused, who is facing charges under Sections 498-A, 323, 328, 376-D, 504, 506, and 120-B of the IPC, along with Sections 3/4 of the Dowry Prohibition Act.

While rejecting the plea, Justice Sanjay Kumar Singh remarked,

“This Court is of the view that aforesaid allegation is serious blow to the Supreme honour of the victim and offends her self esteem and dignity.”

The case was brought forward by the victim’s mother, who filed a First Information Report (F.I.R.). In the F.I.R., the mother alleged that she had arranged her daughter’s marriage with the accused and also given him Rs 4 lakh to support his business. However, she later discovered that her son-in-law was involved in illegal activities and had restricted her daughter from contacting her.

According to the F.I.R., the daughter eventually revealed that the accused had forced her into illegal activities for financial gain. The mother also stated that when her daughter resisted, the accused beat her and threatened to kill her. Eventually, with police assistance, the complainant and her husband managed to rescue their daughter.

The accused’s counsel argued that the case was a result of a matrimonial dispute and that the allegations were false. They claimed that the story was fabricated, including an incident where the accused allegedly barged into the victim’s house with a pistol and tried to drag her away. However, the complainant countered that the accused had married her daughter with the intention of exploiting her and forcing her into prostitution.

The prosecution alleged that once the victim started living at her matrimonial home, the accused harassed her by sending his friends and others into her room, forcing her into physical relationships. The victim was subjected to sexual abuse by these individuals, an act described as heinous by the prosecution.

The court, after hearing arguments from both sides, observed,

“Having heard learned counsel for the parties and examined the matter in its entirety, I find that as per the prosecution case, it is not a simple case of matrimonial dispute between husband and wife.”

The court further noted that such incidents leave the victim degraded and humiliated. It added,

“A rapist not only cause physical injuries, but more indelibly leaves a blot on the most cherished possession of a women i.e. dignity, honour and reputation.”
