KOLKATA: Former Judge Abhijit Gangopadhyay, now a BJP candidate for the Tamluk Lok Sabha seat, escalated a significant legal challenge against what he describes as unjustified police actions. This development unfolded when Gangopadhyay approached the Calcutta High Court on Monday, bringing allegations of police overreach in a case filed against him.

The case in question involves a severe accusation of attempt to murder under section 307 of the Indian Penal Code. Gangopadhyay’s lawyer, Rajdeep Majumder, argued that the FIR (First Information Report) was strategically lodged to disrupt his client’s political campaign. The hearing, set before Justice Jay Sengupta, is scheduled for an urgent review on the following Tuesday.

Gangopadhyay’s entry into the political arena followed his resignation from his judicial position at the Calcutta High Court in March. His transition from the judiciary to politics has been marked by this contentious incident, which reportedly occurred during his visit to file his nomination papers. During this event, he was purportedly protested against by individuals claiming to represent a teachers’ organization.

Majumder pointed out the timing and nature of the police’s actions as evidence of “malafide and overaction.”

He expressed concerns that these measures were taken specifically to impede Gangopadhyay’s engagement with the electorate and influence the upcoming election results in a manner unfavorable to his client.

This legal battle brings to the forefront questions about the intersection of law enforcement and political competition, especially in cases involving candidates with judicial backgrounds.

The outcome of this case could have broader implications for how former judges are treated when they enter the political fray and how allegations of criminal conduct are handled by law enforcement during politically sensitive periods.

PREVIOUSLY IN THE CASE

The West Bengal police lodged a First Information Report (FIR) against Bharatiya Janata Party (BJP) candidate and former judge of the Calcutta High Court, Abhijit Gangopadhyay, for allegedly assaulting dismissed school employees at their protest site. The FIR also names Bharatiya Yuva Morcha (BJYM) leader Prashanta Das.

According to media, Gangopadhyay and Das have been booked for attempt to murder and other offences under the Indian Penal Code (IPC) following a complaint by certain teaching and non-teaching staff members who lost their jobs after a ruling from the Calcutta High Court.

The incident reportedly occurred on May 4 when Gangopadhyay, accompanied by party colleague Suvendu Adhikari, led a rally before submitting his nomination papers for the Tamluk Lok Sabha seat. During the rally, some BJP supporters allegedly assaulted the protest site of primary teachers who had lost their jobs.

Following the incident, the affected teachers lodged a complaint with the police against Justice Gangopadhyay and Das.
